This Acceptable Use Policy (AUP) outlines the expectations and rules for use of the Hostycare Hosting Service. Any violation of this AUP may result in immediate suspension or termination of the Service. In the event of any dispute between Hostycare and the User regarding the interpretation of this AUP, Hostycare's interpretation, in its reasonable commercial judgment, will take precedence.
This Acceptable User Policy (AUP) is an agreement between Hostycare and the account holder. It outlines the legal and ethical responsibilities of the account holder when using Hostycare's services.
By agreeing to this AUP, the account holder understands that Hostycare has the right to suspend or cancel their access to any or all of the services provided by Hostycare if they are found to be using the account inappropriately.
Hostycare also reserves the right to modify the terms of this AUP at any time. The account holder agrees to be bound by any changes to the AUP and agrees to check the AUP regularly for updates.
The account holder understands that it is their responsibility to ensure that their use of Hostycare's services is lawful and in accordance with the terms of this AUP.
By agreeing to this AUP, the account holder agrees to indemnify and hold Hostycare harmless from any claims resulting from their use of Hostycare's services.
Hostycare does not allow content that is offensive in nature, including but not limited to pornographic, hateful, harassing, or threatening material. We reserve the right to suspend or terminate any account that violates this policy.
Internet abuse including hacking, phishing, malware distribution, spam, or unauthorized access attempts is strictly prohibited.
Users must ensure responsible participation in all forums, chats, and networks and must not misuse Hostycare services for unlawful purposes.
This Plan Upgrade Policy (“Policy”) governs the terms and conditions related to the upgrade of hosting plans and add-on services provided by Hostycare (“Company”, “we”, “us”, or “our”). By purchasing, upgrading, or using any Hostycare service, the customer (“User”, “you”, or “your”) agrees to be legally bound by this Policy.
1. Eligibility for Plan Upgrade
1.1 Users subscribed to a Monthly Plan may upgrade to a higher-tier Monthly Plan within the same service category or from a Monthly Plan to a Yearly Plan within the same service category.
1.2 Users subscribed to a Yearly Plan may upgrade only to a higher-tier Yearly Plan within the same service category.
2. Same Service Category Requirement
2.1 All upgrades must remain within the same service category unless expressly approved by Hostycare in writing.
2.2 Cross-category upgrades are subject to availability and Hostycare’s sole discretion.
3. Add-On Upgrade Policy
3.1 Add-ons such as CPU, RAM, storage, bandwidth, or similar resources may be upgraded only within the same billing cycle as the primary plan.
3.2 Monthly plans allow Monthly add-on upgrades only, and Yearly plans allow Yearly add-on upgrades only.
4. Upgrade Charges, Billing & GST
4.1 Upgrade charges are calculated on a prorated basis for the remaining billing cycle.
4.2 All upgrade charges are non-refundable and non-reversible.
4.3 Applicable GST and taxes shall be charged in accordance with the Central Goods and Services Tax Act, 2017.
5. No Downgrade Policy
Once upgraded, no plan or add-on may be downgraded, reverted, or reduced under any circumstances.
6. Refund Policy
No refunds, credits, or adjustments shall be provided once an upgrade has been processed.
7. Compliance with Indian IT Laws
This policy is governed by the Information Technology Act, 2000. Electronic records and invoices generated by Hostycare shall be legally valid.
8. Governing Law & Jurisdiction
This Policy shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of Indian courts.
9. Acceptance of Policy
By using or upgrading Hostycare services, the User confirms acceptance of this Policy in full.
Plan Upgrade Policy:
Customers may upgrade to higher-tier plans within the same service category only. Monthly plans may be upgraded to higher Monthly plans to yearly also or to Yearly plans. Yearly plans may only be upgraded to higher Yearly plans. Add-ons must follow the same billing cycle as the main service. Once upgraded, downgrades are strictly not permitted. All upgrade charges are non-refundable. GST and applicable taxes will be charged as per Indian law.
This Backup & Data Retention Policy (“Policy”) defines the terms under which HostyCare (“Company”, “we”, “us”, or “our”) provides backup, data storage, and data recovery services. By purchasing or using any HostyCare service, the customer (“User”, “you”, or “your”) agrees to be legally bound by this Policy.
1. Backup Availability
1.1 HostyCare shall store backups only if the User has either: (a) purchased a paid backup service separately, or (b) received backup services as part of a hosting plan where backups are explicitly included.
1.2 If backup services are not included in the plan or purchased separately, HostyCare shall have no obligation to maintain or provide any backup.
2. Backup Recovery Eligibility
2.1 Backup recovery is possible only while the service is in an Active or Suspended state.
2.2 Backups cannot be restored once a service is terminated, irrespective of whether backups existed previously.
3. Service Termination & Data Loss
3.1 Once a service is terminated due to non-renewal, overdue invoices, or policy violations, all associated data and backups are permanently deleted.
3.2 Terminated services are non-recoverable under any circumstances.
4. Backup Retention Period
4.1 HostyCare retains backups for a maximum period of 7 days from the service due date.
4.2 During this 7-day suspension period, the User must renew the service to become eligible for data restoration.
4.3 If the service is renewed during the suspension period, backups may be restored subject to availability.
4.4 After service termination, backup restoration is strictly not possible.
5. Notifications & Communication
5.1 HostyCare sends approximately 4–5 reminders via email, ticket, and/or system notifications before and after service suspension.
5.2 Our support team may also attempt to contact the User via phone regarding service renewal.
6. User Responsibility
6.1 The User is solely responsible for maintaining accurate and up-to-date email addresses and mobile numbers in their account profile.
6.2 If the User fails to respond to reminders, calls, or emails due to incorrect or inactive contact details, HostyCare shall bear no responsibility for data loss or backup unavailability.
6.3 Backup management is the User’s self-responsibility.
8. Compliance with Indian IT Laws
This Policy is governed by the Information Technology Act, 2000. All electronic records, logs, and invoices generated by HostyCare shall be legally valid.
9. Governing Law & Jurisdiction
This Policy shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of Lucknow (Uttar-Pradesh) Indian courts.
10. Acceptance of Policy
By using HostyCare services, the User confirms full acceptance of this Backup & Data Retention Policy.
Backup Policy Summary:
Backups are provided only with eligible plans or paid backup services. Backup recovery is
possible only while services are active or suspended. HostyCare retains backups for 7 days
from the due date. Once a service is terminated, data and backups are permanently deleted and
cannot be recovered. Users are responsible for maintaining correct contact details. All
backup services are non-refundable.
This Renewal & Addon Services Policy (“Policy”) defines the terms under which HostyCare (“Company”, “we”, “us”, or “our”) manages service renewals, invoices, reminders, and addon services. By purchasing or using any HostyCare service, the customer (“User”, “you”, or “your”) agrees to be legally bound by this Policy.
1. Invoice Generation
1.1 HostyCare automatically generates invoices 10 days before the service due date.
1.2 The invoice will be sent to the registered email address of the User.
2. Payment Reminder Notifications
2.1 HostyCare sends automated reminder emails to ensure timely payment:
• First Reminder: 6 days before the invoice due date
• First Overdue Reminder: 5 days after the due date
• Second Overdue Reminder: 3 days after the due date
• Final Overdue Reminder: 1 day after the due date
2.2 These reminders are sent via email and/or system notifications.
3. Service Suspension & Termination
3.1 If payment is not received by the due date, the service may be suspended.
3.2 If the invoice remains unpaid for 7 days after the due date, the service will be permanently terminated.
3.3 Once terminated, all associated data will be permanently deleted and cannot be recovered under any circumstances.
4. Customer Responsibility
4.1 The User is solely responsible for renewing services before the due date.
4.2 The User must ensure that their registered email address is accurate and accessible.
4.3 HostyCare shall not be responsible for missed reminders due to incorrect or inactive contact details.
5. Addon Services Policy
5.1 If the User has purchased any addon services, those services are directly linked to the primary (master) service.
5.2 The User must pay the invoice for both the master service and all associated addon services together.
5.3 If payment is not made by the due date, both the master service and all addon services will be suspended or terminated simultaneously.
6. Governing Law & Jurisdiction
This Policy shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of Lucknow (Uttar Pradesh) courts.
7. Acceptance of Policy
By using HostyCare services, the User confirms full acceptance of this Renewal & Addon Services Policy.
Policy Summary:
Invoices are generated 10 days before the due date. Multiple reminders are sent before and after due dates.
Services are terminated after 7 days of non-payment. Once terminated, data cannot be recovered.
Addon services must be paid along with the main service, or both will be suspended/terminated.
This Data Migration Policy (“Policy”) defines the terms under which HostyCare (“Company”, “we”, “us”, or “our”) provides website and hosting account migration services. By requesting or using any migration service, the customer (“User”, “you”, or “your”) agrees to be legally bound by this Policy.
1. Migration Eligibility
1.1 Free migration service is available only to customers who purchase or renew a hosting plan with a billing cycle of 1 year or longer.
1.2 Customers using monthly, quarterly, or semi-annual plans are not eligible for free migration unless otherwise specified by HostyCare.
2. Supported Platforms
2.1 HostyCare supports migration from most popular hosting providers and control panels.
2.2 Supported control panels include but are not limited to cPanel, Webuzo, DirectAdmin, CloudPanel, aaPanel, hPanel and other widely used hosting management panels.
2.3 Migration support is subject to the availability of valid login credentials and technical compatibility.
3. Migration Process
3.1 HostyCare migrates website files, databases, emails, and related hosting data wherever technically possible.
3.2 We do not intentionally modify, alter, edit, or optimize customer data during migration. Data is transferred as-is from the source server to the destination server.
3.3 Directory structures and website configurations are maintained as closely as possible to the original hosting environment.
3.4 Users must provide complete and accurate access credentials required for migration.
4. WordPress & WooCommerce Migration
4.1 HostyCare provides migration support for WordPress, WooCommerce, and most PHP-based websites.
4.2 WordPress websites are migrated using optimized procedures to minimize downtime and maintain functionality.
5. Migration Timeframe
5.1 Migration generally takes between 30 minutes and 2 hours after the migration process has started.
5.2 Larger websites, multiple accounts, email migrations, or oversized databases may require additional time.
6. DNS & Nameserver Update
6.1 After successful migration, the User must update HostyCare's official nameservers or DNS records.
6.2 Website accessibility depends on DNS propagation, which may take up to 24–48 hours in some cases.
6.3 HostyCare shall not be responsible for delays caused by DNS propagation.
7. Localhost Migration
7.1 Free migration services do not include websites stored on localhost or local development environments.
7.2 Users migrating from localhost to a live server are responsible for the migration process unless a separate migration arrangement is approved by HostyCare.
8. Backup Responsibility
8.1 Users are strongly advised to maintain a complete backup of their website and data before migration begins.
8.2 HostyCare shall not be liable for data loss caused by inaccessible source servers, corrupted backups, or third-party hosting issues.
9. Migration Limitations
9.1 HostyCare reserves the right to refuse migration requests involving unsupported software, severely outdated systems, malware-infected websites, or technically incompatible environments.
9.2 Migration service does not include website redesign, bug fixing, code modification, software upgrades, or performance optimization.
10. Acceptance of Policy
By requesting migration services, the User confirms full acceptance of this Data Migration Policy.
This Free Domain & Domain Transfer Policy (“Policy”) defines the terms and conditions governing free domain registration and free domain transfer offers provided by HostyCare (“Company”, “we”, “us”, or “our”). By purchasing any eligible service from HostyCare, the customer (“User”, “you”, or “your”) agrees to be legally bound by this Policy.
1. Free Domain Eligibility
1.1 Free domain registration is available only with eligible hosting plans specifically marked as "Free Domain Included" on the HostyCare website.
1.2 Not all hosting plans include a free domain offer. Only plans that explicitly display the free domain benefit are eligible.
1.3 Customers purchasing a hosting plan without a free domain offer shall not be entitled to claim a free domain.
1.4 Free domain offers are available only with new hosting purchases and cannot be claimed separately.
1.5 Monthly hosting plans are not eligible for any free domain offer.
2. Free Domain Claim Period
2.1 Eligible customers may claim their free domain at the time of hosting purchase or within 30 calendar days from the hosting order date.
2.2 If the free domain is not claimed within 30 days of the hosting purchase date, the free domain benefit shall automatically expire.
2.3 No exceptions, extensions, credits, refunds, or alternative compensation shall be provided once the 30-day claim period has expired.
3. Hosting Renewal & Upgrade Exclusion
3.1 Free domain offers apply only to new eligible hosting purchases.
3.2 Customers renewing an existing hosting plan shall not be eligible for a new free domain.
3.3 Customers upgrading an existing hosting plan shall not be eligible for a free domain offer unless specifically stated by HostyCare.
4. Domain Purchased Without Hosting
4.1 Domains purchased without an eligible hosting plan are not eligible for free registration.
4.2 Customers purchasing a standalone domain must pay the applicable registration fee displayed at the time of purchase.
5. Domain Renewal Charges
5.1 Free domain offers apply only to the initial registration period.
5.2 All future domain renewals shall be charged at the standard renewal rates applicable at the time of renewal.
5.3 Domain renewal charges are separate from hosting renewal charges.
6. Free Domain Transfer Eligibility
6.1 Free domain transfer is available only with eligible hosting plans that specifically include the free transfer benefit.
6.2 Domain transfer requests must be submitted during hosting purchase or within 30 calendar days of the hosting order date.
6.3 Customers requesting domain transfer after the 30-day eligibility period shall not qualify for free transfer benefits.
6.4 Domain transfer benefits are not available without purchasing an eligible hosting plan.
7. ICANN & Registry Transfer Requirements
7.1 The User is solely responsible for ensuring that the domain is eligible for transfer under ICANN and registry policies.
7.2 The domain must be unlocked and the correct EPP/Auth Code must be provided before initiating a transfer request.
7.3 Domains registered, renewed, or transferred within the previous 60 days may not be eligible for transfer due to registry restrictions.
8. Domain Expiry & Transfer Deadline
8.1 To qualify for free transfer benefits and any associated transfer renewal period, domain transfer requests must be initiated at least 60 days before the domain expiration date.
8.2 If a User requests a transfer within 60 days of domain expiry (including but not limited to 30 days, 15 days, or any shorter period before expiration), HostyCare cannot guarantee eligibility for free transfer benefits or any complimentary renewal period.
8.3 In such cases, additional transfer, renewal, recovery, or registry fees may apply according to registry policies.
8.4 Any loss of transfer benefits caused by late transfer requests shall be solely the responsibility of the User.
9. Abuse Prevention
9.1 HostyCare reserves the right to reject, suspend, or cancel any free domain or free transfer request obtained through abuse, fraud, misleading information, multiple-account misuse, or violation of our Terms of Service.
9.2 Free domain and free transfer offers cannot be exchanged for cash, credits, refunds, or alternative services.
10. Limitation of Liability
10.1 HostyCare shall not be responsible for delays, transfer failures, rejected transfers, registry restrictions, registrar restrictions, domain locks, incorrect contact information, or any issue beyond our direct control.
10.2 All domain services remain subject to the rules and regulations of ICANN and the applicable domain registry.
11. Acceptance of Policy
By purchasing an eligible hosting service and claiming a free domain or free domain transfer, the User confirms full acceptance of this Policy.

Hosting renewals and upgrades do not qualify for free domains. All future domain renewals are charged at standard rates.
