General Acceptable Use Policy

This Acceptable Use Policy (AUP) outlines the expectations and rules for use of the Hostycare Hosting Service. Any violation of this AUP may result in immediate suspension or termination of the Service. In the event of any dispute between Hostycare and the User regarding the interpretation of this AUP, Hostycare's interpretation, in its reasonable commercial judgment, will take precedence.

This Acceptable User Policy (AUP) is an agreement between Hostycare and the account holder. It outlines the legal and ethical responsibilities of the account holder when using Hostycare's services.

By agreeing to this AUP, the account holder understands that Hostycare has the right to suspend or cancel their access to any or all of the services provided by Hostycare if they are found to be using the account inappropriately.

Hostycare also reserves the right to modify the terms of this AUP at any time. The account holder agrees to be bound by any changes to the AUP and agrees to check the AUP regularly for updates.

The account holder understands that it is their responsibility to ensure that their use of Hostycare's services is lawful and in accordance with the terms of this AUP.

By agreeing to this AUP, the account holder agrees to indemnify and hold Hostycare harmless from any claims resulting from their use of Hostycare's services.

Offensive Content

Hostycare does not allow content that is offensive in nature, including but not limited to pornographic, hateful, harassing, or threatening material. We reserve the right to suspend or terminate any account that violates this policy.

Internet Abuse

Internet abuse including hacking, phishing, malware distribution, spam, or unauthorized access attempts is strictly prohibited.

Newsgroup, Chat Forums, Other Networks

Users must ensure responsible participation in all forums, chats, and networks and must not misuse Hostycare services for unlawful purposes.

Hostycare – Plan Upgrade Policy

This Plan Upgrade Policy (“Policy”) governs the terms and conditions related to the upgrade of hosting plans and add-on services provided by Hostycare (“Company”, “we”, “us”, or “our”). By purchasing, upgrading, or using any Hostycare service, the customer (“User”, “you”, or “your”) agrees to be legally bound by this Policy.

1. Eligibility for Plan Upgrade

1.1 Users subscribed to a Monthly Plan may upgrade to a higher-tier Monthly Plan within the same service category or from a Monthly Plan to a Yearly Plan within the same service category.

1.2 Users subscribed to a Yearly Plan may upgrade only to a higher-tier Yearly Plan within the same service category.

2. Same Service Category Requirement

2.1 All upgrades must remain within the same service category unless expressly approved by Hostycare in writing.

2.2 Cross-category upgrades are subject to availability and Hostycare’s sole discretion.

3. Add-On Upgrade Policy

3.1 Add-ons such as CPU, RAM, storage, bandwidth, or similar resources may be upgraded only within the same billing cycle as the primary plan.

3.2 Monthly plans allow Monthly add-on upgrades only, and Yearly plans allow Yearly add-on upgrades only.

4. Upgrade Charges, Billing & GST

4.1 Upgrade charges are calculated on a prorated basis for the remaining billing cycle.

4.2 All upgrade charges are non-refundable and non-reversible.

4.3 Applicable GST and taxes shall be charged in accordance with the Central Goods and Services Tax Act, 2017.

5. No Downgrade Policy

Once upgraded, no plan or add-on may be downgraded, reverted, or reduced under any circumstances.

6. Refund Policy

No refunds, credits, or adjustments shall be provided once an upgrade has been processed.

7. Compliance with Indian IT Laws

This policy is governed by the Information Technology Act, 2000. Electronic records and invoices generated by Hostycare shall be legally valid.

8. Governing Law & Jurisdiction

This Policy shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of Indian courts.

9. Acceptance of Policy

By using or upgrading Hostycare services, the User confirms acceptance of this Policy in full.

Plan Upgrade Policy:
Customers may upgrade to higher-tier plans within the same service category only. Monthly plans may be upgraded to higher Monthly plans to yearly also or to Yearly plans. Yearly plans may only be upgraded to higher Yearly plans. Add-ons must follow the same billing cycle as the main service. Once upgraded, downgrades are strictly not permitted. All upgrade charges are non-refundable. GST and applicable taxes will be charged as per Indian law.

HostyCare – Backup & Data Retention Policy

This Backup & Data Retention Policy (“Policy”) defines the terms under which HostyCare (“Company”, “we”, “us”, or “our”) provides backup, data storage, and data recovery services. By purchasing or using any HostyCare service, the customer (“User”, “you”, or “your”) agrees to be legally bound by this Policy.

1. Backup Availability

1.1 HostyCare shall store backups only if the User has either: (a) purchased a paid backup service separately, or (b) received backup services as part of a hosting plan where backups are explicitly included.

1.2 If backup services are not included in the plan or purchased separately, HostyCare shall have no obligation to maintain or provide any backup.

2. Backup Recovery Eligibility

2.1 Backup recovery is possible only while the service is in an Active or Suspended state.

2.2 Backups cannot be restored once a service is terminated, irrespective of whether backups existed previously.

3. Service Termination & Data Loss

3.1 Once a service is terminated due to non-renewal, overdue invoices, or policy violations, all associated data and backups are permanently deleted.

3.2 Terminated services are non-recoverable under any circumstances.

4. Backup Retention Period

4.1 HostyCare retains backups for a maximum period of 7 days from the service due date.

4.2 During this 7-day suspension period, the User must renew the service to become eligible for data restoration.

4.3 If the service is renewed during the suspension period, backups may be restored subject to availability.

4.4 After service termination, backup restoration is strictly not possible.

5. Notifications & Communication

5.1 HostyCare sends approximately 4–5 reminders via email, ticket, and/or system notifications before and after service suspension.

5.2 Our support team may also attempt to contact the User via phone regarding service renewal.

6. User Responsibility

6.1 The User is solely responsible for maintaining accurate and up-to-date email addresses and mobile numbers in their account profile.

6.2 If the User fails to respond to reminders, calls, or emails due to incorrect or inactive contact details, HostyCare shall bear no responsibility for data loss or backup unavailability.

6.3 Backup management is the User’s self-responsibility.

8. Compliance with Indian IT Laws

This Policy is governed by the Information Technology Act, 2000. All electronic records, logs, and invoices generated by HostyCare shall be legally valid.

9. Governing Law & Jurisdiction

This Policy shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of Lucknow (Uttar-Pradesh) Indian courts.

10. Acceptance of Policy

By using HostyCare services, the User confirms full acceptance of this Backup & Data Retention Policy.

Backup Policy Summary:
Backups are provided only with eligible plans or paid backup services. Backup recovery is possible only while services are active or suspended. HostyCare retains backups for 7 days from the due date. Once a service is terminated, data and backups are permanently deleted and cannot be recovered. Users are responsible for maintaining correct contact details. All backup services are non-refundable.

HostyCare – Renewal & Addon Services Policy

This Renewal & Addon Services Policy (“Policy”) defines the terms under which HostyCare (“Company”, “we”, “us”, or “our”) manages service renewals, invoices, reminders, and addon services. By purchasing or using any HostyCare service, the customer (“User”, “you”, or “your”) agrees to be legally bound by this Policy.

1. Invoice Generation

1.1 HostyCare automatically generates invoices 10 days before the service due date.

1.2 The invoice will be sent to the registered email address of the User.

2. Payment Reminder Notifications

2.1 HostyCare sends automated reminder emails to ensure timely payment:

• First Reminder: 6 days before the invoice due date
• First Overdue Reminder: 5 days after the due date
• Second Overdue Reminder: 3 days after the due date
• Final Overdue Reminder: 1 day after the due date

2.2 These reminders are sent via email and/or system notifications.

3. Service Suspension & Termination

3.1 If payment is not received by the due date, the service may be suspended.

3.2 If the invoice remains unpaid for 7 days after the due date, the service will be permanently terminated.

3.3 Once terminated, all associated data will be permanently deleted and cannot be recovered under any circumstances.

4. Customer Responsibility

4.1 The User is solely responsible for renewing services before the due date.

4.2 The User must ensure that their registered email address is accurate and accessible.

4.3 HostyCare shall not be responsible for missed reminders due to incorrect or inactive contact details.

5. Addon Services Policy

5.1 If the User has purchased any addon services, those services are directly linked to the primary (master) service.

5.2 The User must pay the invoice for both the master service and all associated addon services together.

5.3 If payment is not made by the due date, both the master service and all addon services will be suspended or terminated simultaneously.

6. Governing Law & Jurisdiction

This Policy shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of Lucknow (Uttar Pradesh) courts.

7. Acceptance of Policy

By using HostyCare services, the User confirms full acceptance of this Renewal & Addon Services Policy.

Policy Summary:
Invoices are generated 10 days before the due date. Multiple reminders are sent before and after due dates. Services are terminated after 7 days of non-payment. Once terminated, data cannot be recovered. Addon services must be paid along with the main service, or both will be suspended/terminated.
